1. Introduction

Welcome to Britannia English Academy. These Terms of Service ("Terms") govern your access to and use of the Britannia English Academy website, services, and applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our Services.

Please read these Terms carefully before using our Services. By using our Services, you represent that you are at least 16 years of age, or that you are a parent or guardian of a minor who has your permission to use the site.

2. Definitions

  • "We," "us," "our" refers to Britannia English Academy, a company registered in England and Wales.
  • "You," "your" refers to the individual or entity accessing or using our Services.
  • "Services" refers to the Britannia English Academy website, courses, materials, and any related services offered by us.
  • "Content" refers to all information, text, graphics, photos, designs, logos, videos, and any other materials that appear on our website or services.

3. Access to Services

We grant you a limited, non-exclusive, non-transferable right to access and use our Services for your personal, non-commercial use, subject to these Terms. We reserve the right to modify, suspend, or discontinue any part of our Services at any time without notice or liability.

Access to certain parts of our website or Services may require registration or payment. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4. Course Applications and Enrolment

4.1 Application Process

To apply for our courses, you must complete the application form on our website or via other provided channels. Submission of an application does not guarantee enrolment. All applications are subject to review and acceptance by us based on various factors, including but not limited to availability, eligibility, and background checks.

4.2. Fees and Payment

Course fees are as set out on our website or as communicated to you during the application process. All fees are quoted in British Pounds (GBP) and are subject to change. Payment methods accepted are specified on our website or in communication with you.

A non-refundable registration fee and/or deposit is required to secure your place on a course. Full payment of course fees must be received by the deadline indicated in your offer letter or invoice. Failure to pay fees by the due date may result in loss of your place on the course.

4.3. Cancellations and Refunds

Our cancellation and refund policy is as follows:

  • Cancellations made more than 28 days before the course start date: Full refund of any fees paid (excluding the registration fee).
  • Cancellations made between 14-28 days before the course start date: 70% refund of course fees (excluding the registration fee).
  • Cancellations made less than 14 days before the course start date: No refund.

All cancellation requests must be made in writing to our admissions department. Refunds will be processed within 30 days of approval.

4.4. Course Changes

We reserve the right to:

  • Change the content, schedule, or delivery method of our courses
  • Cancel a course if minimum enrolment numbers are not met
  • Change the instructor or location of a course

In the event of significant changes or cancellations initiated by us, affected students will be offered alternatives or a full refund of fees paid.

4.5. Visa Students

If you require a visa to study in the UK, it is your responsibility to ensure that you have the appropriate visa for your course. We will provide necessary documentation to support your visa application upon receipt of your deposit payment. If your visa application is refused, we will refund any course fees paid (minus the registration fee and any bank charges) upon receipt of the original visa refusal letter.

5. Student Conduct

As a student of Britannia English Academy, you are expected to:

  • Attend all scheduled classes or notify us in advance of any absence
  • Arrive on time for all classes and activities
  • Complete assigned coursework and participate actively in class
  • Treat all staff, teachers, and fellow students with respect
  • Adhere to our code of conduct and any specific rules for your course
  • Comply with UK laws and regulations during your stay

We reserve the right to dismiss any student for serious misconduct, including but not limited to: illegal activities, harassment, persistent disruption of classes, or damage to property. In such cases, no refund of fees will be provided.

6. Intellectual Property Rights

All content included on our website and in our course materials, such as text, graphics, logos, images, audio clips, digital downloads, and data compilations, is the property of Britannia English Academy or our content suppliers and is protected by UK and international copyright laws.

You may access, download, and print content from our website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
  • You may store files that are automatically cached by your Web browser for display enhancement purposes
  • You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution

7. User Content

If you post, upload, or share any content on our website, such as comments, reviews, or social media posts (collectively, "User Content"), you represent and warrant that:

  • You own or have the necessary rights to use and authorize us to use your User Content
  • Your User Content does not violate the privacy, publicity, copyright, or other rights of any person
  • Your User Content does not contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, or otherwise objectionable

By providing User Content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

We reserve the right to remove any User Content from our website at our sole discretion without notice.

8. Limitation of Liability

In no event shall Britannia English Academy, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

Nothing in these Terms shall limit or exclude our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited by English law

9. Indemnification

You agree to defend, indemnify, and hold harmless Britannia English Academy, its directors, employees, partners, agents, suppliers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Services
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right
  • Any claim that your User Content caused damage to a third party

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by the courts of England and Wales.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make changes to these Terms, we will post the revised Terms on our website and update the "Last Updated" date at the top of these Terms. We encourage you to review the Terms whenever you access our Services.

Your continued use of our Services following the posting of revised Terms means that you accept and agree to the changes. If you do not agree to the changes, please stop using our Services.
